2. Eligibility

By using FitVora, you confirm that:

• You are at least 16 years of age.
• If you are under the age of 18, you have obtained permission from your parent or legal guardian where required by applicable law.
• You have the legal capacity to enter into these Terms.

If you do not meet these requirements, you must not use FitVora.

3. Acceptance of Terms

By using FitVora, you agree to comply with these Terms & Conditions, our Privacy Policy, and any additional policies or guidelines published by FitVora from time to time. Your continued use of the application constitutes acceptance of any future updates to these Terms.

4. Personal Use Only

FitVora is intended solely for your personal, non-commercial use. Unless expressly authorized by FitVora in writing, you may not sell or resell the application or its services, use FitVora for commercial fitness coaching or training services, redistribute FitVora content, or use FitVora on behalf of another business or organization.

5. User Accounts

Most features of FitVora can be used without creating an account. Google Sign-In is optional and is provided only to enable features such as cloud backup, synchronization across devices, and easier account recovery. You are responsible for maintaining the confidentiality of your account credentials, ensuring your device and account remain secure, and all activities that occur under your account. If you believe your account has been accessed without authorization, notify us immediately at support@fitvora.app. FitVora is not responsible for losses resulting from unauthorized access caused by failure to protect your account or device.

6. User Responsibilities

When using FitVora, you agree to:

• Provide accurate and truthful information.
• Keep your profile information reasonably up to date.
• Use the application responsibly.
• Follow all applicable laws and regulations.
• Respect the rights of other users.
• Use the application only for lawful purposes.

You are solely responsible for any decisions you make based on the information provided by FitVora.

7. Health & Medical Disclaimer

FitVora is a fitness and wellness application only. FitVora is not a medical device, healthcare provider, physiotherapy service, or medical diagnostic tool. The information, workout plans, exercises, articles, and recommendations provided through FitVora are intended solely for general fitness and educational purposes. They should not be considered medical advice, professional healthcare advice, diagnosis, treatment, rehabilitation, or emergency medical assistance.

8. Before Starting Any Exercise Program

Before beginning any exercise program, you should consider your personal health condition. If you have a serious medical condition, heart disease, high blood pressure, respiratory disorders, have undergone recent surgery, are pregnant, have tuberculosis (TB), have HIV/AIDS, have severe joint, muscle or bone conditions, or any other significant medical condition, you should consult a qualified physician or healthcare professional before using FitVora or performing any exercise recommended by the application. By using FitVora, you acknowledge that you are responsible for determining whether any exercise program is appropriate for your individual circumstances.

9. Exercise Safety

Exercise involves inherent risks. You agree to exercise within your personal limits, use proper form and technique, use appropriate equipment where required, and exercise in a safe environment. Stop exercising immediately if you experience pain, chest discomfort, dizziness, fainting, shortness of breath, loss of balance, or any unusual physical symptoms, and seek appropriate medical attention.

10. No Guarantee of Results

FitVora is designed to help users improve their fitness through consistent training and healthy habits. However, individual fitness results vary significantly based on factors including consistency, nutrition, sleep, lifestyle, genetics, existing medical conditions, exercise intensity and recovery. For this reason, FitVora does not guarantee any specific fitness, weight loss, muscle gain, health or body transformation results. Any testimonials, transformation examples or success stories displayed within the application are illustrative examples only and should not be interpreted as promises or guarantees that similar results will be achieved by every user.

11. Limitation of Fitness Advice

All workout plans and recommendations provided by FitVora are generated based on the information you provide. If the information you enter is inaccurate, incomplete or outdated, the recommendations generated may not be suitable for you. You are solely responsible for ensuring that the information you provide is accurate and for determining whether any exercise is appropriate for your health and fitness level.

12. Uploading Images

To use Progress Tracking, you may upload progress photos and profile photos. Images must be captured using your device camera through the application or selected only where permitted. By uploading images, you confirm that you are the owner of the images, that they contain yourself or individuals who have given you permission, and that they do not violate any applicable laws or infringe the intellectual property or privacy rights of any third party.

13. Prohibited Image Content

Users must not upload images that include:

• Nudity or sexually explicit content.
• Violence or graphic content.
• Illegal activities.
• Copyright-infringing material.
• Hate speech.
• Harassment.
• Terrorist or extremist content.
• Child exploitation material.
• Fraudulent or misleading content.
• Malware or harmful files.

FitVora reserves the right to remove any content that violates these Terms without prior notice.

14. Ownership of User Content

You retain ownership of all photos, images and other content you upload to FitVora. By uploading content, you grant FitVora a limited, non-exclusive, worldwide, royalty-free license to store, process, display your content within your account, and synchronize it across your devices. This license exists solely for the purpose of providing FitVora services.

15. Promotional Use of Transformation Photos

Your privacy is important to us. FitVora will never use your progress photos, transformation photos, testimonials or other personal images for advertising, social media, marketing campaigns or promotional materials without your explicit consent. If FitVora wishes to feature your transformation story, we will first ask for your separate permission through the application. You may give consent, decline consent, or withdraw your consent at any time. If you do not provide consent, your images will never be used for promotional purposes.

16. User Content Removal

FitVora reserves the right to remove or restrict access to any uploaded content that violates these Terms or applicable laws, contains inappropriate or offensive material, infringes another person's rights, creates security risks, or may harm the application or other users. Removing content does not affect our right to suspend or terminate accounts for serious violations.

17. Premium Subscription

FitVora offers optional premium subscription plans that unlock additional features and content, which may include advanced workout programs, a premium exercise library, enhanced progress tracking, additional fitness tools and future premium features. Subscription availability may vary by country.

18. Billing & Payments

Premium subscriptions are processed exclusively through Google Play Billing. By purchasing a subscription, you agree that Google processes your payment, FitVora does not store your payment card information, subscription prices are displayed before purchase, and applicable taxes may be added where required. Google Play's payment policies govern all purchases.

19. Automatic Renewal

Unless canceled, subscriptions automatically renew at the end of each billing cycle. You authorize Google Play to charge your selected payment method for each renewal until you cancel your subscription. You may disable automatic renewal at any time through your Google Play account settings.

20. Cancellation & Refunds

You may cancel your subscription at any time through Google Play. Cancellation prevents future renewals but does not automatically refund payments already made. Refund requests are governed entirely by Google's refund policies. FitVora does not control, approve or process subscription refunds.

21. Intellectual Property

Unless otherwise stated, all intellectual property rights relating to FitVora are owned by FitVora or its licensors. This includes the FitVora name, logo, application design, user interface, source code, workout programs, exercise videos, images and graphics created by FitVora, icons, audio, text and databases. These materials are protected under applicable copyright, trademark and intellectual property laws.

22. Restrictions on Use

Without prior written permission from FitVora, you may not:

• Copy the application.
• Sell or resell any part of the application.
• Redistribute workout programs.
• Download and republish videos.
• Use FitVora content commercially.
• Reverse engineer, decompile or modify the application.
• Attempt to bypass security features.
• Create derivative works based on FitVora.

Any unauthorized use may result in legal action.

23. Acceptable Use Policy

You agree that you will not use FitVora to violate any law, commit fraud, upload malicious software, distribute viruses, harass other users, impersonate another person, create fake accounts, interfere with application security, attempt unauthorized access, circumvent subscription restrictions, or upload false, misleading or harmful information. FitVora may investigate violations and take appropriate action, including account suspension or permanent termination.

24. Service Availability

FitVora continually improves its services. We may add new features, remove outdated features, modify workout content, update subscription benefits or change application functionality. These changes may occur without prior notice and are intended to improve the overall user experience.

25. Account Suspension & Termination

FitVora reserves the right to suspend, restrict or permanently terminate your account, with or without prior notice, if we reasonably believe that you have violated these Terms or applicable laws, misused the application, uploaded prohibited or harmful content, attempted to gain unauthorized access, engaged in fraudulent, abusive or deceptive activities, interfered with the operation, security or integrity of FitVora, circumvented subscription or payment systems, or used the application in a manner that may negatively affect other users or FitVora. Termination of your account does not relieve you of any obligations incurred before termination.

26. User-Initiated Account Deletion

You may permanently delete your FitVora account at any time using the account deletion feature within the application. Deleting your account will permanently remove your account and associated personal information from our active systems, including profile information, workout history, progress photos, weight history, body measurements, workout streaks, XP and achievements, and cloud backups associated with your account. Certain limited information may be retained where required by law, for fraud prevention, dispute resolution, security purposes or backup recovery, after which it will be securely deleted. Deleting your account does not automatically cancel an active Google Play subscription — you must separately cancel your subscription through your Google Play account.

27. Limitation of Liability

To the maximum extent permitted by applicable law, FitVora, its owners, developers, employees, partners, licensors and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages arising from or related to your use or inability to use the application, injuries sustained while performing exercises, incorrect exercise techniques, medical complications, allergic reactions, health conditions aggravated during exercise, fitness decisions made by users, data loss, device malfunction, network interruptions, cloud synchronization failures, third-party service outages, or unauthorized access to your account caused by your failure to secure your device or credentials. You use FitVora entirely at your own risk.

28. No Warranty

FitVora is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, FitVora makes no warranties or guarantees regarding continuous availability, error-free operation, uninterrupted service, compatibility with every device, accuracy or completeness of workout recommendations, or achievement of any fitness goals or body transformation results. While we strive to provide a reliable and secure service, we cannot guarantee that the application will always operate without interruptions, delays or technical issues.

29. Third-Party Services

FitVora integrates with trusted third-party services to provide certain functionality, including Google Play Services, Google Sign-In, Google Play Billing, Firebase and Cloudflare. These services operate under their own terms and privacy policies. FitVora is not responsible for the availability, content or practices of third-party services.

30. Privacy

Your use of FitVora is also governed by our Privacy Policy, which explains what information we collect, how we use it, how we protect it, and your rights regarding your personal information. By using FitVora, you acknowledge that you have read and understood our Privacy Policy.

31. Force Majeure

FitVora shall not be liable for any delay or failure to perform its obligations due to events beyond our reasonable control, including natural disasters, floods, fires, earthquakes, pandemics, government actions, internet outages, cyber attacks, power failures, cloud service failures, telecommunications interruptions or labor disputes.

32. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of India, without regard to conflict of law principles.

33. Dispute Resolution

We encourage users to contact us first to resolve any concerns or disputes informally. If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India, unless otherwise required by applicable law.

34. Changes to These Terms

FitVora may update these Terms & Conditions from time to time to reflect new features, changes in applicable laws, security improvements or business changes. When material changes are made, we will update the "Last Updated" date and may notify users through the application or other appropriate means. Your continued use of FitVora after any changes become effective constitutes your acceptance of the revised Terms.

35. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

36. Entire Agreement

These Terms & Conditions, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and FitVora regarding your use of the application and supersede all prior agreements, communications and understandings relating to the subject matter.
